Welcome to Apartment One! By using our platform, you agree to abide by these terms and conditions. Please read them carefully before accessing or utilizing our services.

1. Definitions

“Platform”: Refers to the Apartment One website and any associated services.

“User”: Includes all renters, landlords, and property managers utilizing the platform.

“Listing”: Refers to properties posted by landlords or property managers.

“Tenant Screening”: Background, credit, and eviction reports provided to renters upon payment of the platform’s service fee.

2. Scope of Service

Apartment One serves as a platform connecting renters with property managers and landlords. We:

Provide renters with access to listings that match their qualifications based on tenant screening results.

Allow landlords and property managers to post properties, including options like senior living, VASH-supportive housing, Section 8 properties, and more.

Facilitate a transparent rental process without additional charges to renters beyond the $100 tenant screening fee.

3. Tenant Screening Fee

Renters are required to pay a one-time $100. The fee includes the cost of the background check as well as access to property listings that match your qualifications. This comprehensive fee covers services such as credit checks, eviction history, and other tenant screening criteria, ensuring you are paired with the most suitable rental options. It also provides you with the ability to view and explore properties that align with your profile, offering a seamless and efficient rental experience.

Tenant screening reports are valid for 21 days. After this period, renters must undergo a new screening to access updated listings.

The screening fee is non-refundable.

4. Landlord and Property Manager Obligations

By registering or posting a property on Apartment One, landlords and property managers agree to:

1. No Additional Fees for Renters:

Landlords and property managers are not allowed to charge renters any additional fees for tenant screening, application processing, or any other service covered by the platform.

The $100 tenant screening fee paid by renters covers all necessary screening and is managed solely by Apartment One.

2. Acknowledgment of Terms:

By signing up or posting a property on the platform, landlords and property managers agree to these terms and acknowledge that any attempt to charge additional fees will result in immediate suspension or removal of their account and listings

3. Accurate Listings:

Landlords and property managers must provide truthful and accurate information about their properties.

Misrepresentation of property details is prohibited and may lead to account termination.

4. Compliance:

Ensure that properties listed meet platform-specific requirements, such as Google My Business ratings for senior living facilities or adherence to VASH and Section 8 guidelines.

5. Listing Requirements

Senior living facilities must have a minimum Google My Business review rating of 3 or above to be eligible for listing.

Properties that support VASH or Section 8 must be clearly indicated during the listing process.

Listings must comply with local laws and regulations.

6. Prohibited Activities

Users are strictly prohibited from:

Posting false, misleading, or fraudulent information.

Soliciting or charging additional fees outside the platform’s agreed terms.

Engaging in activities that harm the platform’s integrity or other users.

7. Limitation of Liability

Apartment One acts solely as an intermediary and is not responsible for disputes between renters and landlords, including but not limited to lease agreements, property conditions, or financial transactions beyond those facilitated by the platform.

8. Privacy Policy

All personal data collected on the platform will be handled per our Privacy Policy. By using the platform, you consent to the collection and use of your data as described therein.

9. Termination of Use

Apartment One reserves the right to suspend or terminate user accounts at its discretion, especially in cases of non-compliance with these terms.

10. Modifications to Terms

Apartment One may update these terms from time to time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the updated terms.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of New Mexico. Any disputes arising from or related to the use of the platform shall be resolved exclusively in the courts located in New Mexico.

12. Background Checks and Tenant Screening

1. Purpose and Scope:

Apartment One conducts background, credit, and eviction checks as part of the tenant screening process to provide landlords and property managers with relevant information about prospective tenants.

2. Consent for Background Checks:

By using the platform and paying the tenant screening fee, renters explicitly consent to Apartment One conducting background, credit, and eviction checks.

Renters agree that the information obtained during the background check may be shared with landlords or property managers for the purpose of evaluating rental applications.

3. Accuracy of Information:

Apartment One relies on third-party services for background checks and strives to ensure accuracy; however, we do not guarantee the completeness or reliability of the reports.

Renters are encouraged to review their screening results and report any discrepancies to Apartment One immediately.

4. Data Privacy and Security:

All background check data is handled in compliance with applicable privacy laws, including the Fair Credit Reporting Act (FCRA) for the U.S. The FCRA ensures the accuracy, fairness, and privacy of consumer information used in credit and background checks. Additionally, we adhere to the Gramm-Leach-Bliley Act (GLBA) to safeguard sensitive financial information and the California Consumer Privacy Act (CCPA) for residents of California, ensuring transparency and control over personal data.

Background check reports are securely stored and only accessible to authorized parties.

5. Limitations:

Apartment One is not responsible for decisions made by landlords or property managers based on tenant screening reports.

The tenant screening fee does not guarantee approval for any specific property.

13. Compliance with Local Laws

Apartment One ensures that all background checks comply with applicable local, state, and federal regulations. Users are responsible for understanding and adhering to the laws in their jurisdiction regarding the use of background check information in rental decisions.
